ISLAMABAD, Jan 28: The Islamabad High Court (IHC) has summoned the Prosecutor General of Islamabad to aid in resolving questions regarding the conduct of two FIRs and separate trials for the same incident.
Justice Mohsin Akhtar Kayani noted that there was one incident subjected to trials in two distinct FIRs, highlighting this as a legal issue.
He urged lawyers to inform the Chief Justice about this order from the judge.
Justice Kayani criticized the practice of judges being appointed from Lahore on deputation who allegedly decide cases without any witness involvement.
He was presiding over the jail appeal of Zeeshan Masih, convicted and sentenced to life imprisonment in a murder case.
Justice Kayani said the existence of two trials for the same incident, and presenting evidence from one trial in another, raises serious concerns for the court.
He remarked that judges are capable of mistakes and emphasized the need for improved prosecutor training. He highlighted that if a judge rushes through a murder case, it could lead to injustice.
Justice Kayani added that he has instructed the member inspection team to arrange training for judges, emphasizing that while mistakes occur, they should not stem from malicious intent. He asserted the High Court’s role in supervising subordinate courts.
The High Court must evaluate lower court operations, questioning how separate FIR and cross-version trials for the same incident came to a decision.
The court adjourned the hearing, pending the assistance of the Prosecutor General Islamabad.
